Toby was born Dec. 12, 1927, and was a lifelong resident of Fort Worth, where he graduated from Polytechnic High School. In 1954 Toby graduated from the University of Texas undergraduate and law school and remained an enthusiastic Longhorn. He practiced law in Fort Worth for 57 years, including seven years as judge in Criminal District Court #1. Practicing law was his passion until cancer got the best of him in October 2010. Toby was honored by the Tarrant County Criminal Defense Lawyers Association in 2003, for his contribution to the legal profession for 50 years of service.
Survivors: Wife of 65 years, Martha Jane Goldsmith; brother, Jimmy Goldsmith; sister, Linda Bagley; daughters, Cynthia Wooten and husband, Thomas Wooten, and Amy Goldsmith and husband, Michael Sandone; and three grandchildren.
