Gary Lester Presnell, age 69, passed away on June 17th, in Raleigh, North Carolina.

He was born in Burnsville, North Carolina to his parents, Clarence and Juanita Presnell. Gary was an incredibly accomplished attorney, that had a penchant for helping everyone, treating everyone with respect, and being honest and straightforward. More importantly he was a magnificent husband, father and human being all around. Every person he met has been impacted in a positive and meaningful way, and his mark will be remembered forever.

He is survived by his wife Marina; his son, John Yancey; his sister, Mitzi; his brothers, Norman and Jim; and his nieces, Zoe and Holly.

Gary's funeral service in Raleigh will be streamed live Wednesday, June 24th beginning at 7:30 pm through Brown-Wynne Funeral Home & Crematory's Facebook page, www.facebook.com/BrownWynne/

The funeral service in Burnsville, NC will be held on Friday, June 26th at 5:00 pm at Yancey Funeral Home, 378 Charlie Brown Rd., Burnsville, NC.

Burial will be held on Saturday, June 27th 10:00 am, at Newdale Presbyterian Church Cemetery,71 Newdale Church Road, Burnsville, NC.

In lieu of flowers, memorial donations may be made in Gary's name to a charity of one's choice.

Gary Presnell was a kind, loving and compassionate man. His work representing those Jesus calls "the least of these" was a labor of love that Gary did to enrich the lives of those who had no power in our very flawed criminal "justice" system. Gary brought hope, kindness and compassion into places of despair -- courtrooms. Gary Presnell is now our Saint Intercessor in Heaven. Gary Presnell -- Pray for Us. Gary Presnell -- Rest in Peace.

Kindness, intelligence, humor, subtle leadership, service to others - these are some of Gary's many fine qualities of character. I knew him best as a lawyer and as a mentor. He excelled at both. The suddenness of his death was jolting and a painful reminder of our mortality. But Gary lived a remarkable life, enriching the lives of others, doing good, and revelling in every day. It was an honor to know him. Deepest sympathy and sincere condolences to Marina and Yancey.

Gary is loved by many. I saw him that morning as he was the first to come in to the attorney room and check his mailbox. Usually he would take a seat at the end of the table quietly awaiting time to go to court. I later saw him that afternoon sitting at the table cutting up with Anthony Turner and some other attorney’s. I deeply enjoyed hearing him joke around with the guys. Anytime he would come in the room I would peek around my computer to make sure I said “Hey Mr. Presnell” or Good Morning Mr Presnell. The attorney room doesn’t feel the same anymore now that your mere presence is gone but your spirit lives here forever. I was so hurt and saddened of the news and at first I didn’t believe it because I had just saw Gary. I send my deepest condolences to his sweet loving wife marina and son Yancey. I will keep this family in my prayers. I couldn’t imagine the pain. I am trusting God to give you renewed strength to weather this terrible storm. Love you Gary and family always. I was honored to have been in the presence of Gary for 5 and a half years being at the Justice Center. I was able to gain lots of knowledge just by hearing the conversations he had with other attorneys. Everyone went to Gary for good knowledge or just to get a good laugh. I met Gary while he was a student at the University of North Carolina at Chapel and we became close friends enjoying many trips around the world sharing our lives with each other. Gary introduced me to so many others that made my life so much better and meaningful. I used his services as a lawyer which he was excellent in doing. My condolences to his family. He will be remembered by all the many people who knew him and his life of service to the greater good of humanity. Rest In Peace Gary for a life well lived.

I was dumbfounded and still are today, when I read the horrible announcement on Facebook by Yancey about his dad’s passing - I was with him earlier in the afternoon that fateful day; kidded around as usual at the Atty’s room at the Wake County Justice Center (theCourt House), right about 3:05pm, we bided each other goodbye as I exited the Ct house & went back to my office; I didn’t know that’ll be my last live interaction with Gary! Simply put - he was a very generous, loving, witty, and wonderful human being I’ve ever met in this town called Raleigh, NC! He always tells me, “you know, you are my best friend” “...l love you John” - after bashing & poking at me with Nigerian jokes! I’ll always tell him - “yeeeaah right?”
We’re always joking and teasing each other a lot about traveling, life and living! And this is how we parted?
HE WILL BE SORELY MISSED BY ALL of us (especially me), who worked and played closely with him!
I wish his soul a Blissful Eternity!

Words cannot express the shock of Gary’s (Fishman’s) untimely death. My thoughts and prayers are with Marina and Yancey. Fishman was a very devoted husband and father. He loved Marina, Yancey and his family very much.
I became friends with Fishman in 1977 and always enjoyed being in his company. There were many fun times. Fishman had a large number of true friends. I was always impressed by the respect and caring that people showed to him. Many peoples lives will not be the same with him gone. It is so hard to put anything in words that do him justice. You will be missed by many and remembered forever.
