Donald H. Hartery Jr.

Don was born in Bluefield, WV, on October 22, 1951. He passed quickly into the arms of his Lord and Savior, March 22, 2021.

He was preceded in death by his parents, Donald Hugh Hartery, Sr. and Marjorie Ellen Harris Hartery.

He is survived by his wife, Marcia Cassandra Hartery of Parrish, FL, his Daughter Pamela Ellen Hartery Fosser (Victor) of Parrish, FL, two stepsons, Robert and John Diekon, both of Sarasota, FL, ten grandchildren, Bobby Diekon, Cassandra LaBounty, Kayla Diekon, Timothy LaBounty, Jr., Van Diekon, Nova Diekon, Hailey Davis, Grace Diekon, Nathan Diekon, and Julian Diekon, three siblings, Kathy Hartery Pearce (Bob) of Tampa, FL, Charles Edward Hartery (Jane) of Bluefield, VA and Teresa Hartery Kellar (Gary) of Sarasota, FL.

Don graduated from USF. He worked for Sarasota County Sheriff’s Office and attended Oral Roberts University, where he obtained his Law degree. Don practiced criminal law as a prosecuting attorney in Florida for 22 years. He retired and went into private practice under the name Hartery Law.

Don and Marcia enjoyed spending summer months in Bluefield, VA, where they golfed, relaxed, and spent time with family. They attended East River Church.

He will be remembered most for his love of family, his dog Tito, his passion for golf, and

his dry wit.

Services will be held at Robert Toale and Sons Funeral Home at Palms Memorial Park in Sarasota, Florida on Monday, March 29, 2021. The viewing will be from 12 – 2 pm, followed by the service and burial.
